General Terms And Conditions
These General Terms and Conditions (hereinafter referred to as "GTC") apply to all services and products (hereinafter jointly referred to as "services") of Classic Car Connection AG (hereinafter referred to as "CCC"). Any natural or legal person or partnership which has concluded a contract with CCC is referred to as customer.
1. scope of application
The GTC apply to all services provided by CCC. The remaining contractual provisions, such as written individual agreements, service descriptions, service level agreements, etc. are subject to the GTC in case of contradictions. The respective current and binding version of the GTC is published on the Internet at www.classiccarconnection.ch and www.britishcarparts.ch
A hardcopy version can be obtained from CCC at any time.
2. services of CCC
CCC does everything in its power to offer its customers a first-class service. CCC has experienced specialist staff and carries out all work to the best of its knowledge.
CCC guarantees a 1 year warranty on all work carried out (on the repair and the new parts used for it). The warranty expressly covers only broken parts and their replacement. The warranty expires if improper use, care or maintenance must be assumed. A warranty claim also expires if, although a defect is present or can be assumed, the vehicle/component continues to be used and all suitable measures to reduce damage are not taken immediately. The warranty obligation of CCC also expires immediately if the owner or third parties process, modify, disassemble or repair the vehicle/component without the consent of CCC.
CCC does not guarantee the uninterrupted and trouble-free functioning of its services and cannot be held liable for processing capacities offered or otherwise granted. CCC may at any time call in third parties for the performance of the contract. Liability for financial and consequential damages is - as far as legally permissible - excluded. CCC is not liable for services rendered by third parties.
3. estimates
CCC prepares quotations for repair and restoration work on request. The work and services offered by CCC are based on the knowledge, information and data available to CCC at the time of the offer and are provided to the best of its knowledge. It is often not possible, even for specialists, to identify any hidden defects in advance or to assess their extent. Offers of CCC are therefore to be understood as estimates with regard to costs as well as processing time and have no claim to absoluteness.
4. placing of orders, right of withdrawal and fulfilment of contract
Orders are to be placed in writing or verbally or are confirmed by CCC in writing or verbally. Unless the client expressly requests the written form, verbal orders are also valid in full. A withdrawal of the order by the client is only possible with full payment of all costs incurred up to that point and even then only for reasons of force majeure. All events or circumstances beyond the control of the contracting parties which affect the performance of the contract and cannot be averted despite the application of due care shall be deemed to be force majeure. Claims for damages are excluded and the customer has no right to withdraw from the contract due to delays in delivery. In the case of both repair and maintenance work of vintage vehicles, the time of performance is often dependent on the supply of spare parts and is therefore not always in the power of CCC.
5. project changes / unforeseen events
Any unforeseeable findings, additional customer requests and other expenses deviating from the original order will be agreed with the customer orally or in writing. Unless the customer expressly requests the written form, verbal orders are also valid in full.
All work and spare parts not included in the offer, but which may be additionally required in the course of the work, shall be deemed unforeseen and shall be carried out/installed under supervision and invoiced together with the final invoice on a time and material basis. CCC prepares detailed work and material reports, copies of which will be handed over to the customer upon request.
6. terms of payment
The customer undertakes to pay the invoiced amount within 10 days from the date of the invoice date.
Within the payment period, the customer may raise objections to the invoice in writing and with reasons. Thereafter, the invoice shall be deemed accepted without reservation. If the customer does not meet his payment obligation within the time limit, he shall be in default upon expiration of the same without further reminder and shall pay default interest of 6%. CCC is entitled to charge at least CHF 30.00 per reminder as well as possible storage costs (currently CHF 140.00/month for one vehicle). Further charges remain reserved. If payment is not received by the expiration of the payment deadline, CCC is entitled to discontinue all services to the customer without further notice. CCC reserves the right to keep vehicles and/or processed components of the same in retention until full payment of the claims made by CCC.
7. invoicing
For larger orders, CCC issues staggered invoices on account according to the progress of the work, the material used and the invoices received for third-party services. On request, the client will receive sporadic project reports on the current status of the work. After completion of the work, a final invoice will be issued according to expenditure, which is due for payment within 10 days of delivery or invoicing.
8. right of exchange & return
For defective articles a return right of 8 days applies. Without timely notice of defects, the CCC disclaims any further liability for delivered products, and any resulting damage. Goods that do not fit or have been ordered in excess can be returned within the same period after consultation. For goods ordered incorrectly by the customer, a handling fee of 20% of the net value of the goods will be charged. In addition, packaging and postage costs are to be paid by the customer. Returns with a value of less than Fr. 50.00 can not be refunded for economic reasons. The legitimacy of the return is at the sole discretion of CCC and must always be accompanied by the relevant copy of the invoice. CCC is expressly not liable in the event of improper use of the products supplied by it. Excluded from an exchange or return are customer-specific special orders, personalized articles as well as specially manufactured individual items and all electronic components. If CCC is proven to have supplied a faulty/defective part, liability shall only extend to this replacement part, but not to its replacement or the rectification of defects that may have arisen in connection with it.
9. place of jurisdiction and applicable law
Swiss law is generally applicable. The place of jurisdiction for all disputes that may arise from contracts with CCC is 9620 Lichtensteig/SG.
